GENERAL CONDITIONS OF USE AND SALE

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING THIS SITE AND MAKING A PURCHASE.

The use of this trevi.com web site (the "Site") operated by Trevi Inc. ("Trevi" or "we" or "us") is governed by these terms and conditions (the "Terms"). These Conditions apply to your use of the Site and to any purchase you make on the Site in addition to our Delivery Policy and Return Policy. By using the Site, you agree to abide by these Terms. If you do not agree to these Terms, please do not use the Site and do not make a purchase from the Site.

These Terms and Conditions may be modified at any time and without prior notice by Trevi. Any changes will take effect as soon as they are posted on the Site. Your use of the Site will be subject to the most recent version of the Conditions posted online. In the event of a conflict between an amendment and an earlier version of the Terms and Conditions, the more recent version shall prevail. Please check the Terms and Conditions regularly. If you do not or cannot accept these Terms or any updates to them, please immediately stop using the Site.

Intellectual Property

It is strictly prohibited to use any trademarks or logos reproduced on this Site without the prior written permission of their respective owners. You may not upload, post, publish, transmit, reproduce or distribute in any way information or other material obtained from the Site that is protected by copyright or other intellectual property right, or derivative works therefrom, without obtaining written permission of the owner of such right.

Links to other websites

The Site contains links to websites operated by third parties. By clicking on these links, you leave the trevi.com site. Trevi has no control over the operation of these Internet sites and the fact that they are listed on the Site does not in any way engage the responsibility of Trevi. We recommend that you pay particular attention to the conditions of use and policies applicable to these sites, particularly with respect to the practices of these third parties regarding the protection of your personal information.

CONDITIONS OF SALE OF THE TREVI.COM SITE

Accuracy of information

We make every effort to ensure that the information on the Site is complete and accurate. However, we do not guarantee that the information on the Site is free of errors, incomplete or up to date. We assume no responsibility for any errors or omissions that may appear on the Website, including information relating to product descriptions, prices and availability. All prices shown are in Canadian dollars.

Trevi reserves the right to correct any errors, inaccuracies or omissions at any time without notice or liability toward you. Trevi also reserves the right to modify, at any time, information on prices and availability of products, and any other element of the content of the Site without notice.

The product illustrations displayed on the Site are for information purposes only. It is possible that the products may differ somewhat from their illustration, particularly with respect to colors and patterns. Certain weights and measures are also approximate and are provided for convenience only. We invite you to always read the complete product description before making a purchase. In addition, the products displayed on the Site are subject to availability. Although we endeavor to update the Site as frequently as possible based on available inventory, it is possible that a delay may occur in updating the Site and that, as a result, a product may not be available even if it is displayed as such on the Site. If the desired product is not available, Trevi reserves the right not to accept your order or to cancel it according to the terms described below in the section "Refusal or Cancellation of an Order.

Availability of products

The delivery date is provided as an indication only. The expected delivery times are of 14 to 30 days for : above ground pools, garden furniture, pavilions and heat pumps. For accessories, small pool equipment and chemicals, the expected delivery times are of 3 to 7 days.

Method of payment/invoicing

Payment by credit card is the only form of payment that allows you to make online purchases on the Site. Only VISA and MasterCard credit cards are accepted.

User account

You may need to create a user account and password to order products online. You are responsible for any and all use (including unauthorized use) of your account and for maintaining the confidentiality of your information. We assume no obligation to verify the identity of the person using your account and you are entirely responsible for the purchases that are made. We reserve the right to suspend or cancel your account with or without cause at any time and without notice.

Refusal or cancellation of an order

Receipt of a confirmation email does not constitute an acceptance of your order or an offer to sell a product.

We reserve the right not to process, accept or cancel, at our sole discretion and at any time, an order including, without limitation, if the desired product is out of stock, if there is an error in the price display or if important information about a product is missing or inaccurate on the Site. In addition, we reserve the right, without prior notice, to limit the quantity of any product for any order or to refuse an order for any reason whatsoever. If we do not process, refuse or cancel an order pursuant to the foregoing, we will notify you and you will not be charged or, if charged, we will refund you. Trevi disclaims all liability in the event of a stock shortage, pricing error and for any damage that may result or be caused by any delay in delivery.

Delivery

The Company will take reasonable steps to meet the delivery date indicated but cannot be held responsible for delivery delays due to causes beyond its control, including but not limited to force majeure and bad weather.

Deliveries will be made outside the building only.

The Buyer accepts that the delivery be made in his/her absence and that the parcel be left in front of his/her door. In case of theft, La Compagnie will not be held responsible.

Upon delivery, if an item or part is missing or damaged, the Purchaser must contact Trevi by email at ventesweb@trevi.ca within 10 days of receiving his/her purchase in order to coordinate the exchange or delivery of the missing or damaged item.

Final sale. No refund or exchange

Sales are final. No return, exchange, credit or refund.

PROTECTION OF YOUR PERSONAL INFORMATION

Trevi is concerned about the protection of your personal information. Please refer to our Privacy Policy to learn about our practices regarding the collection, use, disclosure and retention of personal information.

LIMITATION OF LIABILITY

You understand and agree that use of the Site is at your own risk. The Site and the information and materials contained therein are provided on an "as is" basis, without warranty of any kind, either express or implied, including, but not limited to, warranties as to the security of the Site. Trevi disclaims all responsibility and makes no warranties, including but not limited to a warranty of fitness for a particular purpose or a warranty of reliability and accuracy of the information and elements contained on the Site. We do not guarantee that the Site will always operate uninterrupted or that it will be free of errors, including but not limited to errors in pricing and/or availability of products, failures or breakdowns, that it will be free of any harmful or damaging components, including but not limited to computer viruses and bugs, or that it will be secure or protected against unauthorized access.

In no event shall Trevi and its directors, officers or employees be liable for any costs, expenses (including attorneys' fees), losses or damages whatsoever including, without limitation, direct, indirect, special, exemplary, punitive and consequential damages (including, without limitation, damages resulting from lost profits, loss of data or business interruption) arising out of or in connection with : (i) any error or information that may be found on the Site; (ii) any decision by you directly or indirectly based on the information contained on the Site; (iii) your use of or inability to use the Site; (iv) any failure, error, including, without limitation, a display error as to the price or availability of products; (v) a breakdown relating to the Site; (vi) the collection, use, security, disclosure or retention of your personal information in connection with the Site; and (vii) any computer viruses or bugs in your computer equipment, whether or not caused by your access to the Site. In addition, Trevi will not be liable for the total or partial non-performance of its obligations to you, or for any damages or losses you may suffer, if such non-performance, damages or losses result from an event of force majeure or from circumstances beyond its control. Some jurisdictions may not allow certain limitations and exclusions of liability or damages and may provide for rights and obligations that differ from these Terms. If such laws apply to you, these Terms and Conditions shall apply to the fullest extent permitted by such laws.

WITH THE EXCEPTION OF MANUFACTURERS' WARRANTIES FOR PRODUCTS OFFERED FOR SALE ON THE SITE AND LEGAL WARRANTIES PROVIDED BY LAW, TREVI MAKES NO REPRESENTATIONS OF ANY KIND, IMPLIED OR EXPRESS, REGARDING ANY PARTICULAR USE FOR WHICH A PRODUCT MAY BE INTENDED.

COMPENSATION

By using this Site, you agree to defend, indemnify and hold harmless Trevi, its directors, officers and employees from and against any and all claims, suits, demands, liabilities, costs (including attorneys' fees), damages (including direct, indirect, special, exemplary, punitive and incidental damages) arising out of your use, browsing or connection to the Site, or any other breach of these Terms and Conditions related to the use of the Site.

GENERAL

These Terms are governed exclusively by the laws of the Province of Quebec excluding all rules of private international law or conflict of law, except where prohibited by law. Any dispute, recourse or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in the Province of Quebec, except where prohibited by law.

NOTICE TO CLIENTS OUTSIDE OF QUEBEC :

To the fullest extent permissible pursuant to applicable law, this Contract is governed by the laws of the Province of Quebec, without regard to conflict of laws principles that would require the application of the laws of another jurisdiction.

These Terms and Conditions and the documents referenced therein constitute the entire agreement between Trevi and you with respect to your use of the Site and purchases made on the Site. Trevi's insistence on the strict performance of a clause of this agreement or the fact of not requiring its execution should not be interpreted as a waiver of the application of a clause or a right. In the event that a court of competent jurisdiction finds that a provision of this agreement is null, invalid or otherwise unenforceable, such judgment shall have no effect on the other provisions of this agreement.

SPECIFIC CLAUSES BY PRODUCT

Inground Pools

Buyer's Representations, Warranties and Covenants.

Buyer acknowledges and warrants the following and acknowledges that each of the following representations and warranties is true:

a. He is the owner of the land on which the pool is to be installed, that the location he has chosen for the installation of the pool and its equipment (the "Location") is within the limits of his property and complies with municipal and local regulations and complies with all applicable municipal and provincial regulations, including setbacks from property lines. The Purchaser acknowledges that he/she is solely responsible for choosing the Location of the pool and releases the Company from any liability in this regard.

b. The subsoil of the Site contains no trees, large rocks, stumps, fill dirt, black soil, rock formations, cement blocks, cemented structures, significant water veins, construction debris or debris of any other nature;

c. The subsoil of the Site contains no sumps, pipes, basins, wires, cables, septic tanks, conduits or other structures;

d. The Site is not encumbered by any right, servitude or construction of any kind that could prevent or hinder the construction or use of the pool;

e. He has notified the companies and organizations concerned of the installation of the pool, including electricity, water, sewer, gas and telephone suppliers, as well as municipalities, agencies and government departments;

f. The surface and underground water conditions of the Site are suitable for the construction and use of a swimming pool, and that in order to ascertain such water conditions, the Purchaser has taken the necessary steps with the municipalities, ministries and other organizations concerned;

g. The airspace above the Site is free of obstacles and complies with Hydro-Québec regulations and standards;

h. If the installation is included: The Purchaser's land will allow the passage of trucks and machinery, which requires a minimum space, free of obstacles (in the air or on the ground such as ledges or ditches, for example), 12 feet wide and 12 feet high;

i. If the installation of a paver is included: The level of the sidewalk or paver around the pool will be higher than the ground surrounding the pool and the final level of the pool will be the highest point of the ground, as determined by the excavator and the Purchaser;

j. He understands and accepts that a canvas-covered step will have wrinkles and that this is normal. In addition, fabrication of the step will take 3 to 4 weeks.

k. If installation is included: Without limiting the generality of the foregoing, the Purchaser confirms that he has communicated to the Company all particularities, distinctions, anomalies and antecedents pertaining to the land where the pool is to be installed, to the Location, as well as any other information relevant to the proper performance of the Company's obligations hereunder.

l. If paver installation is included: He understands and accepts that natural stone presents imperfections, microcracks and color variations and that this is normal.

m. The Purchaser acknowledges that the price of the Pool (installation and/or sale) has been determined, inter alia, on the basis of the statements and representations made by the Purchaser to the Company by the Contract, including Section 10 (collectively, the "Purchaser's Declarations"). If installation is included: If the Purchaser's Representations prove to be false or inaccurate and, as a result, additional work/interventions must be performed and/or additional material must be purchased by the Purchaser, the parties agree to proceed as follows:

(i) the additional charges provided for in the Contract, if any, will apply or (ii) the parties agree to enter into a separate contract in this respect, failing which this Contract may be terminated by operation of law.

Small machinery (if installation is included).

Should the use of small machinery, in particular the use of a front-end loader, be necessary, despite the declarations made by the Purchaser above, the Purchaser will assume all costs. When access to the pool is narrower than 12' in width and/or the height is less than 12', Trevi must use non-standard machinery to build the pool, which will entail additional costs for the customer:

Access 7' to 12' wide and/or 8' to 9' high - Pools under 24': $3,000 + $2,000 for Ontario - Pools 24' to 30': $3,000 + $2,000 for Ontario

- Pools 32' to 34': $3,500 + $2,000 for Ontario

- Pool 36' to 40': $4000 + $2000 for Ontario

Access greater than 4' and less than 7' wide and/or 8' high - 16' to 18' pool: $6,500 + $2,000 for Ontario

- 20' pool: $7,000 + $2,000 for Ontario

- 22' pool: $7,500 + $2,000 for Ontario

- 24' pool: $8,000 + $2,000 for Ontario

- 26' pool: $8,500 + $2,000 for Ontario

- 28' pool: $9,000 + $2,000 for Ontario

However, regardless of the width of the access, if the access and its perimeter are not free of any object that could impede the passage of machinery and its trucks, additional costs will be charged to the Purchaser. These charges will be assessed on site and will be the subject of a separate contract.

If space does not allow the truck or excavator to make the turn, smaller machinery will be required.

Encumbered ground

In the event that, despite the above declarations by the Purchaser, the ground of the Site is cluttered, the Purchaser who wishes to entrust Trevi with the task of clearing the said ground must agree with his installer on a service agreement to this effect.

Excavated soil (if installation is included).

All excavated soil will be removed by the Company.

Cracks (if sidewalk installation is included).

There may be a slight difference in color and superficial cracks in the sidewalk cement. Superficial cracks are defined as cracks the thickness of a business card. It's important to measure cracks after thawing.

Paving stone and natural stone coping (if paving stone installation is included)

There may be a slight gap between two slabs or a surface crack in the polymer joint.

Work performed by Third Parties

The Purchaser acknowledges that: (i) Trevi makes no reference or recommendation regarding the products or services of Third Parties; (ii) Trevi makes no representation or warranty of any kind with respect to the products or services of Third Parties; (iii) Trevi assumes and has no responsibility for the products or services of Third Parties; and (iv) any contract between the Purchaser and Third Parties is at the Purchaser's risk.

Consent for Sanimarc/Biogard Marketing Materials

The Purchaser hereby gives its informed and voluntary consent to receive marketing materials, including promotional emails, newsletters, product updates and other related communications, on behalf of Trevi, a company operating under the laws of Quebec. The Purchaser understands that these marketing materials may include information about Trevi's services, products, special offers, events and other relevant content. The Purchaser acknowledges that he/she is providing this consent without any form of coercion and is aware that he/she may withdraw his/her consent at any time by following the unsubscribe instructions provided in the marketing communications. The Buyer is aware that Trevi will process my personal information, including contact details, for the purpose of sending marketing materials. He understands that his personal information will be processed in accordance with Trevi's Privacy Policy and in compliance with applicable data protection laws in Quebec. By providing this consent, he/she confirms that he/she has read, understands and accepts the terms and conditions set forth herein, and grants Trevi permission to send marketing materials to the contact information provided herein.

WHAT IS NOT INCLUDED IN THE SALE AND INSTALLATION PRICE IN THIS CONTRACT

a) Electrical installation for accessories, unless otherwise specified in the Contract;

b) Additional work that must be performed if the soil contains loose soil, large rocks, large stumps, large roots or other significant debris;

c) Burying the back-wash hose;

d) Trenching for electrical wiring. This must be done by the Purchaser, according to the electrician's specifications;

e) Additional costs for non-standard machinery, if required, and for levelling the site if it is not level;

f) Installation of solar roller and solar blanket;

g) If an ozonator is sold by Trevi, the Purchaser must install it on a pole. The ozonator must be higher than the water level of the pool in order to be effective. Failure to follow this recommendation could result in damage to the ozonator.

h) Landscaping after pool installation;

i) Removal of toxic materials from the Site into the Site basement. In the event that the toxicity of excavated installation of the pool, decontamination shall be assumed by the Purchaser or a subsequent contract shall be concluded between the Purchaser and the Purchaser;

j) Any excess bedding stone if the elevation of the property makes such excess necessary;

k) Services related to any soil problems that may involve electrical wires, septic fields, septic tanks, natural gas lines, natural gas line, sprinkler system or other.

l) For the Futura model: no excavation required for site preparation if there is less than a 4" difference in elevation. If the slope is 4'' or more, machinery may be required. An additional fee of $300/inch will apply.

m) Fees for surveyor services.

n) Soil testing services.

Exclusions relating to electrical installations

a) The digging of the trench for the burial of the electrical cable, if applicable; this digging must be carried out by the Purchaser, according to the specifications of his electrician;

b) All work to be done in the event that: (i) the electrical panel no longer has room for a circuit breaker; (ii) the electrical panel is of a discontinued make (examples of discontinued panels: Commander, CEB, Sylvania, Taylor, ITE BLLoad enter or Blue Line, fuse panel);

(iii) the installation requires more than 50 feet of wire (the price of wire varies according to the market); (iv) the home's electrical supply is not sufficient for the addition of the pool connection; (v) the electrical panel is at or near the front of the house and the wire must be run inside the house; (vi) the wire to power the pool cannot be buried (asphalt, cement or other);

c) Any electrical connection or installation, as well as all electrical and/or plumbing work.

Wire prices are subject to change without notice, in accordance with market conditions.

It is the Purchaser's responsibility to have his water analyzed (free of charge) every month and to keep the written results of these analyses. The Purchaser undertakes to familiarize himself/herself with the procedures for opening, maintaining and closing the pool. This information can be found in the store and on the Trevi website via the customer area and videos (www.trevi.ca).

If installation is included:

TAKE NOTE OF THE INSTALLATION DELAYS APPLICABLE:

FOR ALL TYPES OF POOL : FROM THE EXCAVATION DATE, THERE IS A DELAY OF 21 BUSINESS DAYS UNTIL FULL COMPLETION OF THE INSTALLATION.

FUTURA : FROM THE DAY OF THE PREPARATION OF THE YARD, THERE IS A DELAY OF 21 BUSINESS DAYS UNTIL FULL COMPLETION OF THE INSTALLATION.

ANY PAVER AND SIDEWALK STONE WORK REQUIRES EXTRA TIME ON TOP OF THE 21 BASIC BUSINESS DAYS.

PRESTIGE PLUS : FROM THE POURING OF THE CONCRETE TO THE APPLICATION OF THE INTERIOR FINISH, THERE IS A DELAY OF 21 BUSINESS DAYS UNTIL FULL COMPLETION OF THE INSTALLATION.

OBLIGATIONS OF THE BUYER PRIOR TO POOL INSTALLATION

1) The Purchaser undertakes to carefully read the construction estimate that will be sent to him by e-mail (also available online at www.trevi.ca.) prior to the installation of the pool and to ask the Company any questions they may have. The Purchaser understands that a good understanding of the construction specifications is essential for proper cooperation in the installation and maintenance of the pool. The Purchaser also undertakes to familiarize himself/herself with the warranties and various guides and manuals pertaining to the products purchased, which are available at www.trevi.ca the essential elements of which have been explained to the Purchaser prior to the signing of this Contract, which the Purchaser confirms by signing this Contract.

2) The Purchaser must obtain an installation and construction permit from his municipality as soon as Trevi has provided him with the pool plan;

3) The Purchaser must contact info-excavation at least one (1) month prior to the start of work in order to obtain an authorization code (www.info-ex.com/piscine );

4) The Purchaser must ensure that no electrical wires above the Site or sprinkler systems in the basement of the Site can interfere;

5) The Purchaser must contact his insurer to find out if the pool is insured against damage not covered by the Trevi warranty ; If a salt system is to be installed, the Purchaser must ensure that his electrician provides a grounding system so as not to alter the pool's general warranty;

6) The Purchaser must ensure that 2 or 3 functional garden hoses or a water tank are available at the time of installation;

7) The Purchaser must ensure that the pump is plugged directly into an electrical outlet with GFI and not into an extension cord;

8) The Purchaser acknowledges that his presence is required to indicate his choice of Location to the Company's representatives before work commences. The Company assumes no responsibility in the event that the Purchaser chooses an inappropriate or unreasonable pool location;

9) The Purchaser must ensure that the installation of the pool on the Purchaser's property complies with all applicable legislation, in particular municipal by-laws concerning swimming pools;

10) For the Futura model, the Purchaser must ensure that there is at least 4' of unobstructed access to the desired pool location.

11) The Purchaser shall procure an adequate quantity of temporary fencing to comply with municipal by-laws. It is the type of fencing required by the municipality. Trevi will install this fence during the installation of the structure. The fence is mandatory for the start of excavation work. However, if the lot is completely fenced in, the Purchaser must purchase a temporary fence and pickets (1 picket every 5 feet) to fence off the access area made for the passage of machinery;

12) The Purchaser must ensure that all electrical, water, sewer and gas connections are in place. Some of these connections by technicians whose competence is recognized by law. The customer is advised to request and retain a receipt for work by these technicians.

13) The final level of the pool is and will always be the responsibility of the Purchaser, since only he knows what other work will be done on his land following installation of the pool.

14) The Buyer understands that the manufacture of the liner-covered step involves a lead time of 3 to 4 weeks.

PURCHASER'S OBLIGATIONS FOLLOWING POOL INSTALLATION

a) As soon as the pool is up and running and filled, the Purchaser must come to the store with a 500 ml water sample for a complete analysis of the pool's water. It is the Purchaser's responsibility to have the water analyzed (free of charge) every month and to keep the written results of these analyses;

b) The Purchaser undertakes to take note of the procedures for opening, maintaining and closing the pool; The Purchaser can find this information in the store and on the Trevi website via the customer area and videos (www.trevi.ca).

c) The Purchaser undertakes to fence the pool in accordance with current regulations. To this end, the Company invites the Purchaser to contact his or her municipality for further information (see also www.trevi.ca);

d) The Purchaser acknowledges that failure to comply with the Company's recommendations and the obligations set forth in the Contract may result in the deterioration of the pool's condition, its use may be affected and the legal warranty may no longer apply;

e) The Purchaser undertakes to notify the Company immediately of any problems with the use or quality of the pool;

f) The Purchaser agrees not to direct the slabs in his yard, the slopes and gutters of his house and shed towards the swimming pool and the sidewalk to prevent rainwater runoff from damaging the pool or sidewalk in the long term. If the slabs and gutters are directed towards the pool, the Purchaser will have 30 days after completion of the pool installation to correct the situation. After this period, Trevi may cancel the pool warranty.

g) The Purchaser agrees not to put any salt in the pool within 28 days of the pouring of the sidewalk concrete. If this period is not respected, salt water splashes could cause stains in the concrete and Trevi would not be held responsible.

h) The Purchaser understands and accepts that a canvas-covered step will show wrinkles and that this is normal.

Above Ground Pools

Acknowledgement by Purchaser:

The Purchaser acknowledges and warrants the following and acknowledges that each of the following representations and warranties is true:

a) He is the owner of the land where the pool is to be installed; the location he has chosen for the installation of the pool and its equipment (including ladder, steps, solar roller, deck and other accessories, etc.) ("the Location") is within the limits of his property and complies with all applicable municipal and provincial by-laws, including, in particular, any setbacks from the (including ladder, steps, solar roller, deck and other accessories, etc.) ("the Location") is within the limits of his property and complies with all applicable municipal and provincial regulations, including setbacks from property lines, and he is solely responsible for choosing the Location for the pool;

b) The subsoil of the Site contains no trees, large rocks, stumps, fill dirt, black earth, rock formations, cement blocks, cement structures, major water veins, construction or other debris, nor any sumps, drains, basins, wires, cables, septic tanks, pipes or other works;

c) The maximum anticipated difference in elevation of the site where the pool and its various devices will be located is 4" in its longest section and the deepest point anticipated in the centre of the pool, i.e. the lowest point of the pool. the center of the pool, i.e. the saucer, will be between 0 and 4" below the level of the other parts of the pool floor; with regard to the depth of the excavation, the height between ground level and the highest part of the pool must be less than half the total height of the pool;

d) The Site is not encumbered by any right or servitude that could prevent or hinder the construction or use of the pool, and the airspace above the Site is free of any obstacle and complies with the regulations and any standards imposed by Hydro-Québec;

e) The Purchaser has notified the companies and organizations concerned of the installation of the pool, in particular electricity, water, sewer, gas and telephone suppliers, as well as municipalities, agencies and government departments;

f) The surface and subsurface water conditions of the Site are suitable for the construction and use of a swimming pool, and that in order to ascertain such water conditions, the Purchaser has taken the necessary steps with the municipalities, ministries and other organizations concerned;

g) Without limiting the generality of the foregoing, the Purchaser confirms that it has communicated to the Company all particularities, distinctions, anomalies and all relevant/important antecedents relating to the land where the pool is to be installed, to the Site, as well as any other information relevant to the proper performance of the Company's obligations hereunder.

Work performed by Third Parties

The Purchaser acknowledges that: (i) Trevi makes no reference or recommendation regarding the products or services of Third Parties; (ii) Trevi makes no representation or warranty of any kind with respect to the products or services of Third Parties; (iii) Trevi assumes and has no responsibility for the products or services of Third Parties; and (iv) any contract between the Purchaser and Third Parties is at the Purchaser's risk.

Consent for Sanimarc/Biogard Marketing Materials

The Purchaser hereby gives its informed and voluntary consent to receive marketing materials, including promotional emails, newsletters, product updates and other related communications, on behalf of Trevi, a company operating under the laws of Quebec. The Purchaser understands that these marketing materials may include information about Trevi's services, products, special offers, events and other relevant content. The Purchaser acknowledges that he/she is providing this consent without any form of coercion and is aware that he/she may withdraw his/her consent at any time by following the unsubscribe instructions provided in the marketing communications. The Buyer is aware that Trevi will process my personal information, including contact details, for the purpose of sending marketing materials. He understands that his personal information will be processed in accordance with Trevi's Privacy Policy and in compliance with applicable data protection laws in Quebec. By providing this consent, he/she confirms that he/she has read, understands and accepts the terms and conditions set forth herein, and grants Trevi permission to send marketing materials to the contact information provided herein.

It is the Purchaser's responsibility to have his water analyzed (free) each month and to keep the written results of these analyses. The Buyer agrees to follow the procedures available in store or online via custumer access and videos on how to close the pool, which is essential to the good maintenance of the swimming pool (www.trevi.ca).

DELIVERY

Prior to any delivery by the Company, the Buyer agrees to provide a direct access of 52 inches wide, from the street to the location chosen bu the Buyer for the deposit of the goods. Direct access must not include any obstacles or steps.

The Buyer must provide a sufficiently large location, equivalent to the dimensions of 2 to 4 pallets of 48 inches by 48 inches, depending on the dimensions of the pool.

The Buyer also undertakes to protect fragile or valuable items and to cover and protect all surfaces that may be damaged during delivery.

The Buyer understands that during the delivery, the grass and plantations of all kinds may be damaged and/or the floor of the building may be soiled.

OBLIGATIONS OF THE BUYER PRIOR TO THE INSTALLATION OF THE POOL :

Obtaining an installation and construction permit from the municipality.

Contacting your insurer to make sure your pool is insured in case of damages which are not covered by the Trevi warranty. See the exclusions indicated in your Trevi General Warranty.

Selecting a location for the pool and filtration system prior to delivery. The Purchaser must place a post at the exact center of the location where the pool is to be installed.Buying patio stones for the filtration system : two 24'' X 24'' stones. Add two more 24'' X 24'' stones if there is a heat pump. Make sure there is a 24'' free space all around the heat pump or water heater. See specifications depending on the type of water-heater or heat pump because a greater clearance may be required.

If a natural gas or propane water heater is on the contract, a poured concrete slab is required for its installation. It must be present for plumbing installation. Note that patio slabs are not compliant for this type of product.

Ensuring that there is no electrical wire above the pool or sprinkler system in the ground that could cause problems.

If a salt system is installed, make sure that your electrician install a ground so that your Trevi warranty is not altered.Ensuring adequate access for installation crew.

In the case of a replacement and/or repair of a pool or a liner,, the deck must be removed or raised at least 6 inches so that the pool can be installed as close as possible to the deck. If the deck is not removed or raised, the pool will be installed at a distance of at least 4 inches from the deck.

If the angles of the new pool are not identical to the pool being replaced, the Purchaser shall Be responsible for filling the empty spaces between the pool and the deck.

The Purchaser is responsible for reinstalling the deck after the pool installation is completed.

Providing for the availability of 2 or 3 garden hoses from neighbours or a cistern of water at the time of installation.

The Buyer must provide a direct access of 36 inches wide, from the street to the backyard, for the movement of tools and materials.

The Buyer must ensure that there is approximately 18 inches of clearance around the pool to facilitate the work of the installation team.

If the installation is done at a location where there was a previous pool, the Buyer must clear the river stones or other materials from the bottom of the pool and the existing deck.

The Buyer understands and agrees that he will have to rearrange and readjust the deck following the installation of the new pool.

Ensuring that the pump is plugged directly into an electrical GFI outlet and not into an extension.

The Purchaser is responsible for all landscaping required after pool installation is completed.

IF INSTALLATION IS INCLUDED:

Collection of packing boxes is not included.

FOR FURTHER INFORMATION, THE FOLLOWING SERVICES ARE EXCLUDED IN PARTICULAR:

a) Electrical installation for accessories (unless specified);

b) Additional work required if soil contains loose soil, large rocks, large stumps, large roots or other large debris;

c) Burying the back-wash hose

o) Removal of toxic materials that may be present on the Site or in the subsoil of the Site despite the representations made by the Purchaser above. In the event that the toxicity of the excavated material is discovered at the time of installation of the pool, decontamination shall be assumed by the Purchaser or a subsequent contract shall be concluded between the Purchaser and the Company;

p) Services related to any problems with the soil that may involve electrical wires, septic fields, septic tanks, natural gas lines, sprinkler systems or other;

q) Filling the pool, adding chemicals, installing the step or ladder, solar roller, solar cover and fence;

r) All work related to the garden shed;

s) Salt system, unless specifically provided for;

t) All services required as a result of the fact that the wire to supply the pool or heat pump cannot be buried (asphalt, cement or other). A cost estimate will be provided for the time and material required to make the conduit;

u) All services required if the electrical panel is in front of or further away from the front of the house and the wire must pass through the house; and

v) All services required if installation requires more than 50 feet of wire.

w) Should a breakdown occur during a pool repair or renovation, Trevi assumes no responsibility for labour, parts, panels or equipment other than those purchased from Trevi under this order.

Exclusions relating to electrical installations :

a) The digging of the trench for the burial of the electrical cable, if applicable; this digging must be carried out by the Purchaser, according to the specifications of his electrician;

b) All work to be done in the event that: (i) the electrical panel no longer has room for a circuit breaker; (ii) the electrical panel is of a discontinued brand (examples of discontinued panels: Commander, CEB, Sylvania, Taylor, ITE BLLoad enter or Blue Line, fuse panel); (iii) the installation requires more than 50 feet of wire (the price of wire varies according to the market); (iv) the electrical supply (v) the electrical panel is on the front or more toward the front of the house (an estimate of the cost will be made to pass the wire inside) ; (vi) the wire to power the pool cannot be buried (asphalt, cement or others) ;

c) Any electrical connection or installation, as well as all electrical and/or plumbing work.

Wire prices are subject to change without notice, in accordance with market conditions.

OBLIGATIONS OF THE PURCHASER FOLLOWING INSTALLATION OF THE POOL :

·1) As soon as the pool is up and running and filled, the Purchaser must go to the store with a 500 ml water sample for a complete analysis of the pool water. It is the Purchaser's responsibility to have the water analyzed (free of charge) every month and to keep the written results of these analyses;

·2) The Purchaser undertakes to take note of the procedures for opening, maintaining and closing the pool; The Purchaser can find this information in the store and on the Trevi website via the customer area and videos (www.trevi.ca).

·3) The Purchaser undertakes to fence the pool in accordance with current regulations. To this end, the Company invites the Purchaser to contact for more information (see also www.trevi.ca);

·4) The Purchaser acknowledges that failure to comply with the Company's recommendations and the obligations under the Contract may result in deterioration of the pool, its use may be affected and the legal warranty may no longer apply;

.5) The Purchaser undertakes to declare without delay to the Company any problem of use or quality of the pool;

.6) The Purchaser undertakes not to orient the slabs in his yard and the gutters of his house and shed towards the pool in order to prevent rainwater run-off from damaging the pool in the long term and voiding the warranty.

.7) The Buyer is responsible for disposing of the cartons and packaging in which the pool and its accessories were delivered.

THE INSTALLATION CREW IS NOT RESPONSIBLE FOR :

Filling the pool and adding chemical products.

Installing the removable steps or ladder, solar blanket, reel and fence.

Any problem involving the ground, such as underground wires, drain fields, septic tanks, natural gas lines, sprinkler systems or other.

Providing the necessary explanations for the proper functioning of the pool.

Spas

The Purchaser bears sole responsibility for:

a) The selection of the spa's location, and, to that end, the Purchaser shall affix a picket in the center of the selected site.

The Purchaser shall be responsible and liable for any inconveniences or costs resulting from a wrong site selection.

Fees will be charged to the Purchaser in the event that the spa can not be introduced at the location chosen and a new delivery date must be set. IMPORTANT: The purchaser must ensure to leave a full clearance zone of at least 60 cm (24 inches) around the spa so that if a repair is necessary the technician has the space required to work (not applicable to HydroTher brand spas).

b) The preparation of a level surface on which the spa will reside, or, in the case of an encased spa, a level surface supported by a solid structure;

c) Conformity with legislation and municipal and other regulations in respect of spas;

d) Any required electrical and plumbing installations;

e) Connections or hook-ups to the electrical grid, water supply, sewers and gas. Some connections and hook-ups can be performed only by qualified technicians in accordance with legislation and regulations. Purchasers are advised to keep the receipt for the work done by technicians;

f) Acquiring, for all moveable spa units, a 110-volt, 20-amp grounded circuit; or acquiring, for all 220-volt models, 40 or more-amp grounded circuit;

g) Disposing of the soil, turf and other material removed in order to install the spa. The Purchaser may request the Company to remove such soil, turf and other material provided he pays the fees of 500$ plus taxes for such additional services.

However, the Company is not responsible for the removal of toxic matters which may be found on or underneath the spa.

Should the toxicity of such matters be discovered only at the disposal site, the Purchaser shall reimburse the Company for the additional cost required to dispose of toxic matters; Disposing of boxes and wrapping papers;

h) Raising or modifying structures on the property such as solariums, decks, storage facilities and other structures.

i) Making sure the Site is not encumbered by any right or servitude that may prevent the use of the spa, and the airspace above the Site is free of obstructions and complies with Hydro-Québec regulations and standards.

Hydro-Québec regulations and standards;

If the contract is in the name of a company, the company agrees to make strictly personal use of Dynasty or Lacus brand spas and not to use it in a commercial manner (not applicable to HydroTher brand spas).

This Contract is governed by the laws of the Province of Quebec, without regard to conflict of laws principles that would require the application of the laws of another jurisdiction. It is agreed by and between the Client and Trévi that all disputes and matters whatsoever arising under, in connection with or incident to this Contract shall exclusively be litigated before the courts of the Province of Quebec, to the exclusion of the courts of any other jurisdiction, province or country.

NOT INCLUDED

  • Delivery inside the residence.Anchoring for the gazebo (if applicable).
  • Delivery: (i) if the access is less than 100 inches high and 42 inches wide for spas less than 92'' or less than 110 inches high and 48 inches wide for spas over 92''; or (ii) if there are obstacles or stairs to be climbed or descended on the path that delivery personnel must take on the Buyer's property; the Buyer will be responsible for all additional costs incurred for delivery of the spa in these circumstances. Such costs may include, but are not limited to, costs related to the use of a crane weighing over 40 tons or other non-standard crane, if applicable.

These costs will be subject to a separate agreement.Stone dust (unless it is included in the contract).

Soil and sod removal.

Packing boxes removal.

Electrical connection (unless it is included in the contract).

Digging the trench for burying the electrical cable, if necessary; this digging must be carried out by the Purchaser, according to the specifications of his electrician.

Installation of GFI (ground-fault circuit interrupter required) (not applicable to HydroTher brand spas).

Installation of spa cover support and spa cover.Installation of the steps.

Exclusions relating to electrical installations:

Except as otherwise provided in this Contract, the services set out below are excluded from the Contract and are the responsibility of the buyer. They may be provided by the Company pursuant to a separate agreement between the Company and the Buyer:

1. The digging of the trench for burial of the electric cable;

2. Any service or work relating to the shed; and

3. The installation of a wireless conduit to power the pool or the heat pump cannot be buried (asphalt, cement, etc.)

A surcharge will be required, and an estimate will be given to the Buyer in the following circumstances:

1. The electrical panel has no more space for the addition of a circuit breaker;

2. The brand of the buyer's electrical panel has been discontinued (examples of discontinued panels: Commander, CEB Sylvania, Taylor, ITE BLLoad Center or Blue Line, fuse panel) [price set case by case];

3. The installation requires more than 25 feet of wire;

4. The electrical panel is on the front or more toward the front of the house (an estimate of the cost will be made to pass the wire inside) ;

5. The power supply of the residence is not sufficient for the addition of the connection.

The price of the wire may vary without notice.

For 13' / 17' / 19' swim spas, the customer must make separate connections to connect the electrical packs. · In the case of 13' and 17' spas, there are 2 packs, so there must be 2 connections to two 60A circuit breakers.

· In the case of 19' spas, there are 3 packs, which implies 2 connections with 2 60A circuit breakers and one connection with a 40A circuit breaker.

DELIVERY

The Purchaser agrees to carefully read the spa delivery preparation guide that will be sent by e-mail (also available online at www.trevi.ca prior to delivery of the spa and to ask the Company any questions, if necessary. The Buyer understands that a full understanding of the preparation guide is essential for proper cooperation during spa delivery (not applicable to HydroTher brand spas).

The Purchaser also agrees to familiarize himself/herself with the warranties and the various guides and manuals pertaining to the products purchased at www.trevi.ca, the essential elements of which have been explained to Purchaser prior to the signing of this Contract, which the Purchaser confirms by signing these presents.

The basic delivery charges only cover deliveries outside the building. Prior to any delivery by the Company, whether provided outside or inside a building, the Buyer undertakes to free up maximum space to allow the Compan and safely proceed with the delivery, including aisles, corridors and entrances that must be free of obstacles.

The Buyer also undertakes to protect fragile or valuable items and to cover and protect all surfaces that may be hung during delivery. The Buyer understands that during the delivery, the grass and plantations of all kinds may damaged and/or the floor of the building may be soiled. The Buyer undertakes to ensure that a responsible adult is present throughout the delivery, in particular to confirm that the delivered product is in good condition and tha complies with the product purchased under this Contract.

THE PURCHASER'S RESPONSIBILITIES AFTER THE SALE

The Purchaser acknowledges that failure to comply with the Company's recommendations and obligations under the Contract may result in deterioration of the spa, its use may be affected and the legal and/or contractual warranty may no longer apply;

a) As soon as the spa is running and filled, the Purchaser must go to the store with a 500 ml water sample for a complete analysis of the spa water. It is the It is the Purchaser's responsibility to have his or her water analyzed (free of charge) every month and to keep the written results of these analyses;

b) The Purchaser undertakes to familiarize himself/herself with the SPA's opening, maintenance and closing procedures; The Purchaser can find this information in the store and on the Trevi website via the customer area and videos (www.trevi.ca). c) The Purchaser agrees to follow the free in-store courses on opening, maintaining and closing the spa;

d) Fill spa and add chemicals;

e) Install gazebo, if any (unless installation is included in Contract).

f) Clean spa cover on a monthly basis with a store recommended product.

g) The Purchaser agrees to notify the Company immediately of any problems with the use or quality of the spa;

h) The Purchaser agrees not to direct the slabs in his yard or the eaves troughs of his house or shed towards the spa, in order to prevent rainwater from running off the spa. of rainwater from damaging the spa in the long term and from voiding the legal and/or conventional warranty;

i) The Purchaser must contact his insurer to find out whether the spa is insured against damage that is not covered by the Trevi warranty indicated in the Trevi warranties. www.trevi.ca;

j) The Purchaser is responsible for and agrees to read the warranty and the various guides and manuals pertaining to the spa on www.trevi.ca;

h) If the installation of the gazebo is done by Trevi, the Purchaser agrees to vacate the site and ensure that it is level before the arrival of Trevi's installers.

If your spa is not functional during winter

We remind you that the warranty does not cover problems with your spa caused by freezing and winter weather. Accordingly, you are asked to follow the procedures carefully in order to effectively protect your spa during winter. These are explained in the online documentation on Trévi's website, as well as in the store during spa closing course provided free of charge. In addition, the spa lid must be in place. A sheet of plywood must be placed on top of the lid and a winter tarp draped over the entire spa to protect your spa and prevent water infiltration.

Furniture, Gazebos, Parasols, Swings and Saunas

DELIVERY

Prior to any delivery by the Company, the Buyer undertakes to clear as much space as possible to allow the Company to proceed easily and safely with the delivery, including aisles, corridors and entrances which must be free of obstacles.

The Buyer also undertakes to protect fragile or valuable objects and to cover and protect all surfaces that may become snagged during delivery.

The Buyer understands that during delivery, grass and plantings of all kinds may be damaged and/or the floor of the building may be soiled.

The Buyer undertakes to have a responsible adult present at all times during delivery, in particular to confirm that the product delivered is in good condition and conforms to the product purchased.

CARE GUIDE

FURNITURE:

Regular cleaning with non-abrasive products will help maintain the original beauty of your furniture. If you keep your furniture outside this fall, be sure to regularly brush off fallen leaves to avoid stubborn stains. Furniture made of wood has to be stained once or twice a year minimum. We recommend that you thoroughly clean your furniture before storing it away for the winter. If possible, place it in a garden shed or basement. Although most of our furniture is guaranteed to withstand the cold, it is better to bring your furniture inside to avoid winter damage or at least keep it shielded from bad weather.

Please note that the cover of your furniture is designed to protect against the harmful effects of the sun , is not waterproof and should never be used to winterize your outdoor furniture. It is recommended to treat the cover with a protective waterproofing and anti-uv coating. If the cover is used during the winter season, it could cause premature wear and/or discoloration of said cover.

FABRICS:

Follow instructions provided or contact your Trevi representative for more information.

ARTIFICIAL PLANTS :

Products designed for indoor use. If you plan to put them outside, protect them from rain and direct sunlight. This will prolong the life of your plants.

TECK :

Treatment is recommended for teak furniture if you want to keep the original look, otherwise the furniture will change color and its life span could be reduced. Returned merchandise is subject to inspection by the Manager. Please allow ten (10) working days for the processing of warranty claims.

Using teak oil

1. Surface preparation: Make sure the teak surface is clean, dry and free of any old finish or dirt before applying the oil.

2. Application: Use a brush, clean cloth or sprayer to apply the oil evenly to the wood.Follow the manufacturer's instructions for drying times between coats.

3.Regular maintenance: To maintain the beauty and protection of the surface, we recommend reapplying the oil once or twice a year, or as needed, depending on exposure to weather, UV rays and wear.

Self-combustion hazard warning

➢ Soaked rag: After using a rag to apply teak oil, it can become a hazard if mishandled. Oil-soaked rags can ignite spontaneously due to the heat generated by the oil's polymerization process.

➢ Avoid heat build-up: Never allow oil-soaked rags to accumulate in piles or confined spaces, as this may increase the risk of self-combustion.

➢ Proper disposal: To safely dispose of soaked rags, lay them flat outside in a well ventilated area until they are completely dry. Once dry, they can be disposed of in a fire-resistant garbage can, or better still, in a hermetically sealed metal container reserved for this purpose.

IMPORTANT WARNING PARASOL.

In windy conditions, immediately remove the parasol. Even when closed, the parasol may catch the wind and cause damage to the parasol itself or to other furniture nearby. Resulting damage is not covered by the warranty, so please be careful!

SUN ROOF GAZEBOS AND GARDEN SWINGS - Sun roof gazebos and swings are covered by basic warranties that will be honored by Trevi .

Please note, however, that Trevi cannot be held responsible for improper anchoring or damage due to wind , harsh weather conditions or other causes. You should also be aware that these items are equipped with a roof that is intended to provide protection from the sun and is not guaranteed to be fully waterproof. We also wish to inform you that pressure cleaning systems can make canvas brittle, cause discoloration and damage the protective UV coating on these accessories. If such systems are used, all warranties will be void.

If you choose to install your gazebo or pavilion yourself, it is your responsibility to ensure that no parts are damaged during installation due to lack of expertise or experience. Carefully read all instructions prior to installation. If the installation is done by Trevi, the work itself will be guaranteed for one (1) year starting from the installation date. Installation is done by Trevi, the work itself will be guaranteed for one (1) year starting from the installation date.

GAZEBOS - The Purchaser is responsible for ensuring a solid, level, well-draining site for the installation of its gazebo, pavilion or parasol, and also for anchoring it correctly to the ground if necessary. Hardware for anchoring is not included.

It is the buyer's responsibility to remove the snow from the roof of its pavilion or gazebo in case excessive build-up. It is strongly recommanded to install a cover on the roof as well as one or many support legs for the winter for steel/aluminium models.

Accordingly, in the absence of a regular and adequate snow removal on the roof, the product warranty shall not applied in the event of a breakage or a total or partial collapse of the pavilion or gazebo roof.

WARRANTIES (complete warranties available at www.trevi.ca)

WHAT'S COVERED

This product is covered by the "Manufacturer's" one (1) year limited warranty.

This warranty, valid for the original purchaser only, certifies that this product is free from defects in materials and workmanship on the date of purchase.

This product is warranted for a period of one (1) year from the date of purchase under normal use and service.

Should a structural failure occur within one (1) year from the date of purchase, we will, at our option, repair or replace the defective part or item.

Where applicable, we reserve the right to substitute equivalent merchandise if the model or color of the item in question is discontinued.

Once the warranty has expired, Trevi cannot guarantee the availability of replacement parts.

Exception: In the case of a gazebo, the warranty is three (3) years on materials and one (1) year on labor.

In the case of a sauna, the warranty is 1 year on heating and electricity and 3 years on interior wood siding and exterior siding (including roof, doors and windows).

WHAT IS NOT COVERED

This warranty does not cover items used for commercial purposes, failures caused by improper care, unreasonable or abusive use, vandalism, water infiltration through the roof (except for saunas), damage caused by weight suspended or hooked to the gazebo structure, unhooking and/or breakage of solar screens in high winds if they have not been reassembled in the valance, damage due to frost or natural disasters (winds, hurricanes, hail, tornadoes, etc. (except for saunas)). (except for saunas)), rust, peeling paint, soiling, discoloration, broken glass, purchased parts and the cost of transporting and packing returned goods.

If, when unpacking the item, scissors, a knife or any other sharp object has been used by the Buyer and has damaged the item, Trevi cannot be held responsible and will reject any claim in this regard.

Proof of purchase will be required for all warranty claims.

WINTER STORAGE IS THE CUSTOMER'S RESPONSIBILITY:

If you intend to store your garden furniture, gazebo, swing, etc. outdoors or in an area where frost could cause damage, first make sure to remove any water that may be extrusions, pipes, joints and connections. To avoid the risk of water seeping into pipes, joints, extrusions, etc., we recommend that you avoid tipping or leaning garden furniture on its side for storage.

Frost damage is not covered by this warranty.

Trevi recommends indoor storage in a heated area.

IF INSTALLATION IS INCLUDED:

If the gazebo is installed by Trevi, the Purchaser agrees to vacate the site and ensure that it is level before Trevi's installers arrive.

Collection of packing boxes is not included.

GAZEBO / PAVILION / SAUNA INSTALLATION

Customer's responsibility prior to installation:
