Terms and Conditions for Online Purchases - Car Shelters

DELIVERY

The Company will take reasonable steps to meet the delivery date indicated but cannot be held responsible for delivery delays due to causes beyond its control, including but not limited to force majeure and bad weather. Deliveries will be made outside the building only.

The Purchaser accepts that delivery is made in his/her absence and that the parcel is left in front of his/her door. In case of theft,the Company will not be held responsible.

The Buyer acknowledges and accepts that Trévi is not responsible for any damage to the product and/or vehicle that may occur during the loading of said product into the vehicle.

GOVERNING LAW

The Purchaser is responsible for checking with the municipality in which the merchandise shall be installed the laws, regulations or orders in effect applicable to the installation and maintenance of the merchandise. The Company makes no representation about the relevant municipal regulations or orders, and shall not be required to pay the Purchaser in the event of whatever impediment with respect to the applicable regulations or laws.

OBLIGATIONS OF THE PURCHASER

The consumer agrees and undertakes:

a) To provide storage for the Merchandise sold from April to October of each year;

b) To maintain and keep the Merchandises sold free of any accumulation of ice, glazed frost or snow in all its forms, dead leaves and any other substances, at its sole cost and expense. In strong winds, close both doors (front and rear) if necessary.

c) It is expressly agreed that all damages resulting from the use by the Purchaser or by anythird party with or without the Purchaser’s consent will be at the Purchaser’s entire and exclusive responsibility.

d) Be responsible for the measurements provided for the shelter dimensions (length, width and height).

e) If the installaton is done by Trevi, during installation, clear the installation site and leave nothing in the parking lot where the installation will take place.

f) The location he has chosen for the installation of the shelter (including anchors or other parts) is within the limits of his property.

THE WARRANTY

This warranty does not cover:

a) The damages caused by ice, ice movements, fire, animals, vegetation, vandalism, extreme weather conditions and fortuitous events.

b) Slumping due to snow accumulations.

c) Damages caused following long exposure to sunlight.

d) Damages caused to persons and goods.

e) Wear and normal fading of the canvas and other components of the shelter.

f) Damages caused during storage. The canvas must be dry, free of leaves or any other dirt and debris during storage.

g) Damages caused by improper installation that wasn't done by the Company.

h) The sections of the canvas being connected by a seam, since it is practically impossible to guarantee total watertightness.

Water infiltration is not considered as a manufacturing defect. 

Note: The temporary car shelter canvas is designed for winter use.

THE ANCHORS

Anchoring is mandatory if the shelter is installed by Trevi.

If the Purchaser carries out the installation himself, Trevi strongly recommends the installation of permanent anchors.

The Purchaser understands and accepts that the anchors ar permanents, once installed.

The anchors must be installed on an asphalt surface, plain pavers or concrete.

 

This Contract is governed by the laws of the Province of Quebec, without regard to conflict of laws principles that would require the application of the laws of another jurisdiction. It is agreed by and between the Client and Trévi that all disputes and matters whatsoever arising under, in connection with or incident to this Contract shall exclusively be litigated before the courts of the Province of Quebec, to the exclusion of the courts of any other jurisdiction, province or country
